Question #33: My friend has been married 10 months. He has decided after trying marriage counseling that he doesn’t want to continue in this marriage. The problem is, he owns his own business and doesn’t want to lose it to his wife… He has asked his wife to leave and she will not… These problems have been going on since the first day of the marriage. Question #32: I have been separated since Nov. 97. I have the car that we purchased during the marriage. I have paid exactly 1/2 of the payments each month. When I first married her the deed was in her name from a previous marriage; since then we took out a second mortgage, and both names are on the deed. We have a temporary legal separation agreement in which he pays child support and half the mortgage. He is now finishing a software product that could make a great deal of money. He has been working on it for over a year, and drained everything we ever had to get it to this point. He “owns” 51% of this software program. Question #26: My wife’s father gave her some shares of stock. Before we got married, we put the stock in both our names. I had some money and added it to that account. Now, my wife tells me that in the case of a divorce, I am not entitled to any of her stock because it was a gift from her father. I know it is not an inheritance because her father is not dead! I am in New Mexico. We used that account to live on in times of need. Yet, we never sold one share of the stock her dad had given her. Now that the money I put into that account is extinguished, can my wife still claim that in the case of a divorce that I have no right to the money even though the account is in both our names. The account says She “or” Me (the “or” clause and not the “and” clause). Also, once we started having problems she started writing checks fast and furiously. If we ever do settle, am I entitled to the money she so furiously spent, or am I just entitled to just what is left in the account (if anything is left)?

Question #25: My husband and I were married in March of 1997, in California. He is currently in the military and we are stationed in Illinois. We are looking at getting a divorce. Mainly the problem is that he has been abusive to me, both mentally and physically. I am not sure what to do at this point and I feel that at this time I’m going to be the one to start the divorce. I have no idea what the laws are in this state and I am looking to move out of the house. I have no job to support the bills that he claims are all mine, which aren’t, they’re joint. As part of the divorce document my ex-husband agreed to pay me $8000 per year towards furthering my education, due on June 1st of each yr – for 4 yrs. He has not paid me any money and said he won’t. Even though he agreed at the time he wanted to help me go back to college. He says he does not have the money, but he is a professor and makes a good salary, he could get a loan I’m sure. I helped put him through college, BS, MA, PhD, etc. How can I get this money from him? Without having a full-fledged court battle? Any advice would be appreciated.
