Answer: in a Community Property State or Equitable Distribution State you would be entitled to one have of all the marital property which includes all property acquired during the course of the marriage which was not acquired by gift or inheritance, regardless of in whose name such property appears. Thus, you should have a claim to your wife’s corporation if it was acquired during the course of the marriage .
