I am divorcing my wife for the second time. I had an affair with her best friend after my wife wouldn’t touch me for eight months. In our first marriage, my wife would refuse to have sex with me for long periods of time. The longest I ever went was 14 months. I told her as we were preparing for our second marriage that I couldn’t live like that, and she promised never to hold out on me. Well, 1 1/2 years into our marriage, I had gone for eight months when her best friend approached me. I know what I did was wrong, and I’ve never done it before or since. My question is, now that she knows, and we are getting a divorce, do I have any rights?

I am a 42-year-old woman with four children. I have been married for 21 years. Recently my husband has spoken of divorce. I want to know if he would need grounds? What are those grounds, and could I contest them? If I challenge them, could he still get a divorce? He just recently took a job making 1/5 the amount of money he used to. Would my alimony be based on the amount he now makes, or would it be averaged over the years? Thanks for your help!

I was married in New Jersey, live and been married for 21 years now, and things are bad. I had an affair a few weeks ago, and my wife found out. She has threatened to kick me out, change the locks, and take everything. She told me she would file based on adultery and take everything we own and leave me with nothing. Can she do this? Resident oN.Y.NY state. We were married here and lived here. We separated two months ago, and she wanted to be on her own for a while. We had a separation agreement drawn up and signed. I kept 2 of our three children, and she was allowed to move out of state with our son. No support on either side, I kept house. She now knows she can’t live without the other children and is returning to the area. Her boyfriend, whom she left me for, now has a job offer in this area. She has stated if he comes here, she would resume her relationship with him. She wants to stay married, but if he takes the job, I would like a divorce based on adultery. She has been living in the same apartment with this man in South Dakota. What proof do I need for adultery? If she doesn’t contest to adultery, how quickly would the marriage be dissolved? She believes that since we are separated that she can legally have relations with someone else and that it would not constitute adultery? I believe she is definitely wrong, so who is right?

I was married in December of 1997. In March of 1999, my wife told me that she did not want to be married anymore. I agreed and moved out. In November of 1999, she moved to Florida and lived there until July of 2001. Do I have grounds for divorce under abandonment or separation? PS We have a four-year-old son.
