Question #91

I have a family member that wants a divorce from his wife. They haven’t had sex in over two years. Neither one of them would initiate it. About four years ago, he asked her if she would like to renew their wedding vows, she told him NO. Does he have any grounds for divorce in the state of New York?

Not wishing to renew one’s wedding vows is not grounds by itself for divorce.

However, if both parties are in agreement that they would like to divorce, it can be accomplished based on the information you provided.
If they are living in the New York City metropolitan area, please have them call me at 212-370-1660 to make an appointment to discuss the matter at greater length.
