You did not indicate what state you were living in, but in New York although it is not technically necessary to have a separation before the divorce, in practical terms it is important to enter into a Separation Agreement spelling out the exact terms of the separation, (including child custody, child support, spousal support, division of marital assets, etc.) .This does not mean that there must be a waiting period between the Separation and the Divorce. They are generally prepared together in one package and submitted to the Court for approval at the same time.
