I live in NY State. I have been married for about 14 years and have one child, 9 years old. My husband served me divorce papers this year on the grounds of “cruel and inhuman treatment.” Last year, I signed a Post Marital Agreement. I am employed for the past three or four years; however, I accumulated enormous debt (to a tune of 55000 dollars). Is this post-marital agreement valid, and thus I will become ineligible for the house (which is in his name) and his retirement benefits?

I can’t tell you whether the agreement you signed is legally enforceable without reviewing it. Did you have legal counsel when you signed it? Did you understand the terms of the agreement? Did your husband to coerce you sign it against your will?
