I live in NY State, and I am engaged to a man that has been separated from his ex for about five years. He decided to start divorce proceedings, and he hired a lawyer. He subsequently found out that no separation agreement was ever filed with the court. Myfiance and his ex have two children together. He pays $ $504 a month in child support as ordered by the court. His exsaid she would only sign the divorce papers if he agreed to take out life insurance on each child and pay half of all of the kids’ expenses, including college tuition. We live in a small town in upstate NY and make modest incomes. Based on my fiance’s salary, he cannot afford the life insurance premiums for the children. He supports his wheelchair-bound father with $300 a week. He cannot afford any of this.

My question: Can she just hold out on these demands and never sign the divorce papers? My fiance’s lawyer clearly is not an experienced divorce attorney, and he isn’t much help on this matter. I would appreciate it if you could please give me some advice. Thank you so much.

I live in upstate New York. My husband bought a piece of land with an old house on it before we were married.We knocked down the old house after we were married and built a new house.I have paid all the household maintenance bills and contributed to the raw material of the new house.
We have been married for 8 yrs. We have a prenuptial, I think, is invalid. I did not have an attorney and was presented the papers ten days before our marriage. There has been domestic violence on several occasions. I have recently been out of work and am receiving social security disability. I cannot go back to work. He made 138,000 last year but denies I am entitled to anything. We have no children. Please advise.

I have questions concerning spousal support and division of property. We have been married for 26 years and live in an upper-classcommunity in Westchester County, NY. We have two children attending college. My husband has had over 20 affairs during this time (I stopped counting). He is a self-employed attorney and adjunct business law teacher, with an annual income of approximately $20,000. I am a 50% partner in a thrivingcompany and am about to open a new business.My husband incurred over $250k in credit card debt with my name on the account, consistently failed to pay our income taxes, and household bills.As a result,I was forced to refinance our mortgage to pay off the credit card debt. I became solely responsible for the mortgage,even thoughhe remains on the deed. I made him close all the credit card accounts and opened a separate bank account in my name only. I now pay all the household expenses, including all the children’s’ expenses.I now file “married filing separate” tax returns. I want out of this marriage. My children are at an age that they can understand this splitting. But will I be forced to give up half of all that I have worked so hard for for the last 52 yrs? Are my house and my company subject to his spousal claim for support? Will I have to pay him spousal support? Should I just continue to pay for everything now, and hope that I will outlive him?

My Wife and I are in the process of working out a separation agreement. All seems to be going well except for the wording on higher education. Her lawyer drafted the provision for higher education as follows: Both parties agree to contribute reasonably toward the child’s higher education based upon the respective financial circumstances of the parties at such time as she commences her higher education. The parties’ obligation hereunder shall cease at such time as the minor child becomes emancipated as outline din paragraph 14. I am concerned about who decided “reasonable.” My lawyer said a judge would decide. Does this language sound fair, and is it normal in a separation agreement? I wanted it to be worded more specific as to how much each would have to contribute to better prepare and budget for when the time comes.

I have been married for eight years. My wife and I have a baby that turned one in August of this year. On July 4, 2004, I was asked to leave the marital residence and reside in our summer home. There was never any attempt to work things out or reconcile our marriage. Divorce is/was inevitable. My wife currently does not work, based on both of our decisions after the birth of our child. In the meantime, I have fallen in love with my best friend, who has unfortunately made its way around the whole town. We have never been seen in public as affectionate but do spend plenty of time with each other. I go home at least once or twice a day to spend time with my child and have done so ever since July 4, 2004. Since the news of my affair has made its way to my wife, she has now threatened to never let me see my daughter again. I would like to know what my rights are if she can prove adultery. Does she have the right to refuse to allow me to see my child? Does she have the right to tell me who is allowed to be around my child and who is not? And is child/spousal support affected in a case of adultery?
