MOVING RESTRICTIONS

Question #11:
My husband and I live in New York and I am wanting to get a divorce. We have one child together and I was wondering if I had to stay in New York or would I be able to move to North Carolina before the divorce is final. My sister lives down there and she would be able to help me get on my feet because I don't think I would be able to support myself and child if I were to stay in New York.

Answer:

Is your spouse agreeable to you moving with the child?

Once the papers are filed, you could move, assuming
your spouse is in agreement. Otherwise, you will have a
custody battle and will have to convince the judge that your move is in the best interest of the child.
I strongly suggest you mediate this matter with me rather than litigate it in court.

If you are living in the metro NYC area, call me to arrange for a meeting the discuss the matter at greater length.
