FINANCIAL ISSUES - MARITAL PROPERTY V. SEPARATE PROPERTY

Question #190:
I was married 24 years. He worked for city, & retired on pension. (His second marriage) He supported me throughtout. He froze bank acct., and got a lawyer to remove me from our home. Now we have a seperation agreement, He only gave me half of december's alimony, gave it to someone else. I expect this to be a pattern. What happens now. The agreement says to pay monthly, no specific day.

Answer:

It sounds like you did not have legal counsel, or if you did it was very poor legal counsel, when you entered into this separation agreement. I cannot overemphasize the importance of using an attorney-mediator, experienced in matrimonial matters to represent you at such important events such as a separation or divorce.
I would have to see the exact terms of your Separation Agreement to properly advise you regarding how to respond to the failure of your spouse to pay you the spousal support he is obligated to provide under the terms of the Separation Agreement.
If you are living in the New York City metropolitan area, please call me at 212-370-1660 to arrange for a meeting to review the Separation Agreement and to discuss the matter at greater length.
