FINANCIAL ISSUES - MARITAL PROPERTY V. SEPARATE PROPERTY

Question #189:

My husband and I have been married for almost two years. About two months ago, he told me that he was gay and is leaving me. My question is, do I have grounds for an annulment on the basis of fraud?

Answer:

If your husband misled you at the time when you were married and promised that he wanted to live with you and have children , and in fact , he was gay and never intended to have relations with you, you should have enough grounds to get an annulment. Of course , the real answer is in the details and wqhether your spouse will contest the grounds.
If you are in the living in the New York City metropolitan area, please give me a call at 212-370-1660 to discuss the matter at greater length and mediate your annulment. If your husband is cooperative in this matter , the process will be much easier.
