WHAT DOES IT TAKE TO GET A DIVORCE - JURISDICTION, GROUNDS

Question #89:

My husband and I have been separated for three years. I recently filed for divorce but he is contesting the divorce on the grounds that he wants me to be liable for a student loan he received why we were together.

Can I get a divorce on the grounds that we have been seperated for three years?

Answer:

Answer:

Being separated is not recognized as a grounds for divorce. You must have entered into a written separation agreement which was prepared properly with all the legal requirements in order to use the grounds of legally separated for one year or more. There are , however, other alternatives that can be used for grounds.

If you're living in the New York City metropolitan area, I strongly suggest that you call me to discuss mediating the divorce and getting the proper legal counsel that you both need in order to effectively divorce and get on with your lives.
