Can one choose any state in which to file for divorce?
Answer:
Each state has different residency and substantive requirements (e. g. where did the marriage take place, where was the family residence, where do the children reside, where are most of the marital assets located, etc.) in order for that particular state to determine whether it has jurisdiction of the divorce proceeding. A plaintiff has a limited ability to do what is called "forum shopping" or choosing the best court and state to bring the proceeding but the matter requires legal expertise and thus a competent attorney should be consulted to assist you in selecting where to file.
